OJK ISSUES TWO MINERAL AND STRATEGIC COMMODITIES EXCHANGE REGULATIONS
Jakarta, 17 September 2026. Indonesia Financial Services Authority (OJK) issued two Mineral and Strategic Commodities Exchange (BMKS) Regulations (POJK):
- POJK Number 15 of 2026 on Gradual Transition of Duties and Authorities of Regulation and Supervision of Transactions in the Mineral and Strategic Commodities Exchange from the Commodity Futures Trading Regulatory Agency (Bappebti) to Indonesia Financial Services Authority (OJK)
- POJK Number 16 of 2026 on Implementation of the Mineral and Strategic Commodities Exchange
The POJK issuances trailblazed OJK's measure in implementing the mandate of Article 132A of Law Number 4 of 2026 on the Amendment of Law Number 4 of 2023 on the Development and Strengthening of the Financial Services Sector (P2SK Law Amendment), which mandated OJK to regulate and supervise the transactions in the Mineral and Strategic Commodities Exchange (BMKS).
The Mineral and Strategic Commodities Exchange Regulations aimed to establish market infrastructure with capability to carry out efficient, fair, integrous, orderly, and transparent Mineral and Strategic Commodities trading with certainty in price making, clearing, transaction settlement, and risk management.
POJK Number 15 of 2026 on Gradual Transition of Duties and Authorities of Regulation and Supervision of Transactions in the Mineral and Strategic Commodities Exchange from Bappebti to OJK regulates the and aims for seamless and measured transitional procedures of the Mineral and Strategic Commodities Exchange regulatory and supervisory authorities from the Commodity Futures Trading Regulatory Agency (Bappebti) to OJK, maintaining market stability and preventing legal loopholes as well as minimizing operational setbacks for operating business actors.
The authorities and duties transference from Bappebti to OJK will take effect as of the initial operation day of BMKS on 1 January 2027.
Meanwhile in POJK Number 16 of 2026 on Implementation of the Mineral and Strategic Commodities Exchange, OJK strengthens regulatory and supervisory framework on BMKS implementation that stipulates matters such as parties in BMKS trading activities, trade and trade staging procedures, BMKS transactions, governance, risk management, user protection, and integrity enforcement.
BMKS implementation is designed as a part of an ecosystem that integrates trading, clearing, guarantee, transaction settlement, and Electronic Proof of Ownership management functions. BMKS must meet the principles of efficiency, fairness, transparency, certainty on transaction settlement, market integrity, and risk management.
The POJK also contains user protection aspect, which serves to maintain trustworthiness of BMKS implementation and to protect the interests of services users.
With the regulation issuances, OJK expected the BMKS ecosystem to flourish healthily, professionally, and competitively while creating a liquid and trustworthy market in advocating for nurturing investor's confidence in Indonesia financial services industry.
POJK Number 15 of 2026 is effective as of 17 September 2026, while POJK Number 16 of 2026 is effective as of 1 January 2027.
