OJK Issues Circular on SPRINT for Investment Management

The Financial Services Authority (OJK) has issued OJK Circular Letter (SEOJK) No. 7/SEOJK.04/2017 on Electronic Submission of Applications for Licenses, Registration, Recording, Approvals, and Reporting for Individuals or Companies in the Investment Management Field.

This SEOJK serves as the legal foundation for the Integrated Registration and Licensing Information System (SPRINT) and the Mutual Funds Industry Application System (ARIA). Both systems support the electronic licensing, registration, recording, approvals, and reporting processes for players in the investment management field.

In essence, SEOJK No. 7/SEOJK.04/2017 regulates, among others, the following matters:

a. The full-scale imposition and application of the electronic systems for licensing, registration, recording, approvals, and reporting, and other processes, which players in the investment management field can access through SPRINT and ARIA.

b. Documents for licensing, registration, recording, approval, and reporting, and other related purposes as required by capital market legislation, which should be submitted to the OJK and processed through SPRINT, are as follows:

1. documents in relation to Investment Managers;

2. documents in relation to Investment Consultants;

3. registration statements of Collective Investment Contracts of Asset-Backed Securities;

4. registration statements for the purpose of Public Offerings, recording for the purpose of Limited Offerings, changes in Collective Investment Contracts, Prospectuses and/or Information Memorandum, liquidation of Real Estate Investment Trust;

5.registration statements for the purpose of Public Offerings, recording for the purpose of Limited Offerings, changes in Issuance Agreements, Prospectuses and/or Information Memorandum, and liquidation of Asset-Backed Securities in the form of Participant Letters;

6. applications for licenses, for license extensions, and submission of reports by Investment Manager Representative (WMI) license holders;

7. recording, changes in Collective Investment Contracts and/or disclosure documents, and liquidation of Limited Participation Mutual Funds (RDPT)

8. documents in relation to Mutual Fund Selling Agents;

9. applications for licenses and/or license revocations, and submission of reports by Mutual Fund Selling Agents;

10. registration statements, changes in Collective Investment Contracts and/or Prospectuses and liquidation of Mutual Funds in the form of Collective Investment Contracts; and

11. Other processes related to licensing, registration, recording, approvals, and reporting in the investment management industry as stipulated by the OJK.

c. The reports required by capital market legislation, which should be submitted to the OJK and processed through ARIA, are as follows:

1. Investment Manager reports, including those concerning their monthly activities;

2. Mutual Fund Selling Agent reports.

d. Any party that undertakes licensing, registration, recording, approval, reporting, and/or other related processes through SPRINT is required to keep the documents in printed version.

The SEOJK No. 7/SEOJK.04/2017 on Electronic Submission of Applications for Licenses, Registration, Recording, Approvals, and Reporting for Individuals or Companies in the Investment Management Field is effective from the date it is promulgated.
